IN STORE RETURN AND EXCHANGE POLICY

ONLINE RETURN AND EXCHANGE POLICY

Online orders may be returned in-store without a fee, and shipped returns will incur a fee of $9.99. All video game console returns are subject to a $14.99 return shipping fee.

Items purchased online should be returned with all applicable components and original packaging. Items purchased in-store must be returned in-store. We will refund the purchase price and applicable taxes and fees to the original form of payment or provide a replacement, as indicated in this policy. Preowned items are eligible for Online credit only.

TF Games reserves the right to limit, or decline returns or exchanges regardless of whether the customer has a receipt. All returns require a receipt or a tfgames.org order number. Refunds issued for lost items are subject to recharge if TF Games can verify delivery or frequent abuse. All decisions regarding returns are subject to applicable laws. TF Games retains final authority to accept or decline any item that is eligible for return. Under no circumstance will TF Games accept return of an ineligible item. TF Games may, in its sole discretion, refuse return of an item it deems to present a potential health or safety risk to any individual. TF Games also reserves the right to close tfgames.org accounts, or to cancel or refuse orders or returns for violations or abuse of our returns policy, or any fraudulent activities relating to returns.

Claims for “Lost in transit” or “Delivered but not received” orders must be submitted within 7 days of shipment date..

WARRANTY

Limited Warranty

(a) Seller warrants that, for 365 days from the order date, the Goods will materially conform to Seller’s published specifications in effect on the shipment date.

(b) Seller makes no other warranties of any kind. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, title, or non-infringement. All such warranties, whether express or implied by law, course of dealing, course of performance, or usage of trade, are expressly disclaimed.

(c) Seller is not liable for a breach of the limited warranty unless all of the following conditions are met:

  1. Buyer provides written notice to Seller, reasonably describing the defect, within five (5) days after Buyer discovers or should have discovered the defect.

  2. Seller is given a reasonable opportunity to examine the Goods, and Buyer returns the Goods to Seller’s place of business for inspection if Seller requests it, at Seller’s expense.

  3. Seller reasonably verifies that the Goods are defective.

(d) Seller is not liable for a breach of the limited warranty if:

  1. Buyer continues to use the Goods after providing notice of the defect;

  2. The defect results from Buyer’s failure to follow Seller’s oral or written instructions regarding storage, installation, commissioning, use, or maintenance;

  3. Buyer alters or repairs the Goods without Seller’s prior written consent;

  4. The Goods are damaged due to Buyer’s misuse, neglect, or negligence or due to events or circumstances outside the control of TF Games, including storms, floods, violence, government actions, electrical variations or outages, or utility failures; or

  5. For Pre-Owned Goods, the issue is limited to cosmetic imperfections such as scratches, dents, marks, or discoloration.

(e) Seller will, at its sole discretion, either:

  1. Repair or replace the Goods (or the defective part), or

  2. Issue store credit equal to the purchase price of the Goods.

If Seller requests, Buyer must return the Goods to Seller at Seller’s expense.

(f) The remedies  are Buyer’s sole and exclusive remedies and represent Seller’s entire liability for any breach of the limited warranty.

This site, and the materials and products offered on it, are provided with a 365-day warranty from the date of order.

TF Games does not represent or warrant that the functions on the site will be uninterrupted or error-free, that defects will be corrected, or that the site or the servers that make it available are free of viruses or other harmful components.

The TF Games 365-day product warranty is the sole warranty provided for products sold by TF Games. TF Games expressly disclaims all other warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Under no circumstances will TF Games be liable for any special, incidental, or consequential damages, whether arising in contract, tort (including negligence or strict liability), or otherwise. TF Games’ liability for returned, defective, or nonconforming goods will not exceed either the purchase price paid or replacement of the goods, as described above.

This warranty applies only to the original buyer and does not extend to any other person or entity.

This warranty does not apply to apparel, glassware, plushies, stickers, or doormats.
